Tour operator licence of the Icelandic Tourist Board (Ferðamálastofa) no.: [LICENCE NUMBER]
2. Scope
These terms apply to all private tours booked directly with Iceland photos & private tours slf. Tours that include accommodation are package travel under the Icelandic Package Travel Act (Lög nr. 95/2018). Guests' statutory rights remain unaffected in all cases.
3. Booking and contract
- Guests send a booking request via the website or by email.
- The contract is concluded when we confirm the booking in writing (by email).
- Before booking, guests receive the standard package travel information form required by law and all essential tour information.
- The person making the booking acts on behalf of all travellers named in it and is responsible for their payments.
4. Services and prices
The scope and price of the tour are set out in the individual offer and the booking confirmation. All prices are final prices in Icelandic króna (ISK) or the currency stated in the offer, including applicable taxes. We do not increase the price after the booking is confirmed.
5. Payment
- A deposit of 15% of the tour price is due at booking.
- The balance is due no later than 40 days before the tour starts.
- For bookings made less than 40 days before the tour starts, the full price is due immediately.
- If payment is not made on time despite a reminder, we may cancel the contract and charge cancellation fees under section 6.
- All customer payments are protected against the operator's insolvency through: VÍS tryggingar.
6. Cancellation by guests
Guests may cancel at any time before the tour starts. Cancellation must be made in writing (email is sufficient) and takes effect when we receive it. The following cancellation fees apply:
| Cancellation | Fee (of tour price) |
|---|---|
| 35 days or more before the tour | 15% |
| 34 to 15 days before | 50% |
| 14 to 8 days before | 75% |
| 7 days or less before, or no-show | 100% |
These fees cover accommodation already booked as well as planning, vehicle and guiding costs. Guests may prove that our actual loss was lower.
If unavoidable and extraordinary circumstances occur at or near the destination that significantly affect the tour (e.g. a volcanic eruption closing the route), guests may cancel without a fee.
7. Changes and transfer
- Date changes are possible subject to availability. Guests bear any costs already incurred (e.g. hotel fees).
- Guests may transfer the booking to another person up to 7 days before the tour starts. Guests and the new traveller are jointly liable for any additional costs.
8. Cancellation by the operator
We may cancel a tour before it starts if unavoidable and extraordinary circumstances prevent it (e.g. official road closures, severe weather warnings, natural events), or if the guide falls ill unexpectedly and no equivalent replacement is available. We inform guests without delay. Guests choose either a new date or a full refund within 14 days. No further claims arise in these cases.
9. Changes to route and programme
Weather and road conditions in Iceland change quickly, and guest safety comes first. We may adjust the route, order and programme when weather, road conditions or safety require it. Where possible, we replace cancelled stops with equivalent alternatives. If an essential part of the tour changes significantly before departure, we inform guests, who may accept the change or cancel free of charge.
10. Guests' obligations
- Guests follow the guide's safety instructions, especially at beaches, cliffs, glaciers and waterfalls.
- Guests bring weatherproof clothing, sturdy footwear and valid travel documents.
- Guests disclose relevant health restrictions before booking.
- If guests endanger themselves or others despite a warning, we may exclude them from the rest of the tour. The tour price remains payable.
- Guests report any problems immediately during the tour so we can fix them.
11. Liability
We are liable for the proper performance of all contracted travel services under the Package Travel Act. For damage other than personal injury that is caused neither intentionally nor negligently, our liability is limited to three times the tour price. We are not liable for activities guests book separately with other providers (e.g. glacier hikes, boat tours). We are liable for personal belongings left in the vehicle only in cases of intent or negligence.
12. Insurance
We strongly recommend travel cancellation insurance as well as travel health and accident insurance. These are not included in the tour price.
13. Photos
The guide is a photographer and takes photos during the tour on request. We use photos in which guests are recognisable on our website or social media only with their explicit consent.
14. Privacy
We process personal data only to carry out the booking. Details are in our privacy policy.
15. Governing law and disputes
Icelandic law applies. Mandatory consumer protection rules of the guest's country of residence remain unaffected. Guests should first send complaints to lisa@iceland-photos.com. Guests may also contact the Icelandic consumer dispute resolution body: Kærunefnd vöru- og þjónustukaupa (Consumer Complaints Committee for Goods and Services), c/o Neytendastofa, Borgartún 21, 105 Reykjavík, Iceland, www.kvth.is.
16. Language versions and final provisions
These terms are available in German and English. In case of discrepancies, the German version prevails. If any provision is invalid, the remaining provisions stay in effect.
